Booking Terms
& Conditions, Villa Feliz, Playa Blanca, LANZAROTE
1. The property known as Villa Feliz, A9a Calle Vesubio, Montana Roja
(sec25), Playa
Blanca 35570, Lanzarote (the Property) is offered for holiday rental subject
to confirmation by Nick & Jane Bailey (the Owners) to
the renter (the Client).
2. To reserve the Property, the Client should complete and sign
the appropriate Booking Form and return it together with payment
of the initial non-refundable deposit (minimum 25% of the total due).
Following receipt of the Booking Form and deposit, the Owners will
send a confirmation e-mail. This is the formal acceptance of the
booking. Payment can be made by cheque or BACS (direct bank
transfer, BANK details on
form).
Credit card or
PayPal payments attract a 2% surcharge to cover some of the
processing costs.
3. The balance of the rent together with the security deposit
(see
clause 4) is payable not less than 2 months before the start of
the rental period. If payment is not received by the due date, the
Owners reserve the right to give notice in writing/e-mail that the
reservation is cancelled & the initial deposit lost. Reservations made within eight weeks of
the start of the rental period require full payment at the time of
booking. Dishonoured cheques or recalled payments will attract a
charge of £20 on each occasion.
4. A security deposit for the amount as stated on the Booking Form
is required in case of, for example, damage to property or its
contents, lost keys or callouts or additional cleaning (see 8.
below). However, the Security Deposit will not necessarily be
the limit of the Clients liability to the Owners.
The Owners will account to the Client for the security deposit and
refund the balance due within one month after the end of the
rental period payable to first named on booking form by BGC to the
bank account details provided by the Client or by crediting the
Clients' PayPal account.
5. The person who originally signed the Booking Form must make any
cancellations in writing. Cancellations made prior to 56
days, the
Owner will retain only the reservation deposit (or arrange another
date if requested). Between 56 and 22 days, 50% of
the total rental cost and from 21 days before departure, 100% of
the total rental cost. The Owners will do their best to comply
with amendments to the original booking if they are requested in a
reasonable period of time prior to the departure date.
The Owners reserve
the right to charge £25 per person in the event of a change of
booking date to cover administration.
The Client is strongly advised to arrange
a comprehensive travel insurance policy (including cancellation
cover or unable to reach destination due to weather, failure of
airline etc.) and to have full cover for the partys personal
belongings, public liability etc., since they are not covered by
the Owners insurance.
6. The rental period should finish before 10.00hrs (local
time) on the last day
to allow for preparation of the villa for next guests. Late stays
can be prearranged only if there is availability the next day and
50% of the
pro rate daily charge applies. Clients should not expect
access to the property before 16.00hrs (local time) but by
arrangement they may leave their baggage at the property earlier
and return once it is prepared. Should departure flights be
severely delayed or cancelled, by arrangement with the housekeeper &
only if there is availability, the rental period may be extended &
will be charged pro rata to the advertised daily rate.
7. The maximum number of persons to reside in the property must not exceed
that number stated on the Booking Form. Additional guests must be
advised in writing prior to the holiday & a further charge may be applicable.
8. The Client agrees to be a considerate tenant and to take good
care of the Property and to leave it in a reasonably clean and
tidy condition at the end of the rental period. House cleaning is
included in the rental charge and the Owners undertake to change
bedding & towels weekly, but the Owners reserve the right to
make a retention from the security deposit if the property is left
in an unacceptable condition. The Client also agrees not to act in
a manner that would cause disturbance to those residents in
neighbouring properties. The Client is responsible for the
security of the Property during their stay and should take all
reasonable precautions to ensure security of the villa during
periods when they are away from the Property. Smoking is
prohibited at any time within the property.
9. The Client shall report to the Owners agent without delay
any defects in the Property or breakdown of any appliance in the
Property and arrangements for repair and/or replacement will be
made as soon as is reasonably possible.
10. The Owners shall not be liable to the Client-:
(i) For any temporary defect or stoppage in the supply of
public services to the Property, nor in respect of any equipment,
plant, machinery in the property, grounds or swimming pool, although
the Owners will use their best endeavours to restore any services as
soon as possible
(ii) for any loss, damage or injury which is the result of
careless use of the Property, adverse
weather conditions, riot, war, strikes or other matters beyond the
control of the Owners
11. The swimming pool is provided at the Clients risk.
The Pool Rules posted in the property (& provided prior to the
holiday) must be adhered to and the
Owners strongly advise that children or non swimmers are never left unattended in
the pool or surrounding area. The Owners cannot accept any liability
for loss, damage, injury or death related to the Client's use of the
swimming pool.
12. Personal belongings are at the Clients risk. The Owners
cannot accept responsibility for personal injury, illness or loss or damage
related to
Clients belongings.
13. Under no circumstances shall the Owners liability to the
Client exceed the amount paid to the Owners for the rental period.
14. Medical Treatment. you are advised to obtain a
European Health Insurance Card from the Post Office (if travelling from UK). This may
assist you in getting medical aid without payment from public hospitals.
There are also numerous private clinics in Lanzarote. You are
strongly advised to obtain full Travel & Medical Insurance.
N.B. This contract shall be governed by English law
including formation and interpretation and shall be deemed to have
been made in England.
